WILL AND PROBATE

Why do you need a will?

If you die without a will then your estate will be probated under the laws of intestate distribution. This means if you are married the assets and debts in your estate are characterized as either community or separate property. If you are single at the time of your death then it is assumed that your estate consists mainly of your separate property. (Not including special provisions you have in business ventures and partnerships, if any.)

Did you know that without a will:

  • Your ex-spouse could control your children’s inheritance
  • Texas real estate will be controlled by Texas laws, even if you are a resident of another state or country
  • Your children’s entire inheritance will go to them as soon as they reach age 18
  • Texas law makes no provisions for step-children
  • Your spouse could be required to get court approval for every decision concerning your estate
  • Your children from another marriage, not your current spouse, may inherit all of your interest in your home, your bank accounts and all of your other community property.
